One problem with locating things above the chat frame and the info panel is that the chat frame and combat log both have tabs that are above their frames, so if you put buttons or any other mouse activated feature above either of those frames, you run into a conflict with their configuration tabs.
I would also argue that those two action bars are really intended more as auxiliary bars and not main combat bars as are the three between the main screen and the two on either side of the unit frames.
In any event, moving the XP and rep bars to the bottom and moving the two action bars and panel selectors up above them should reduce accidental contact with the fubar (or Titan) mouseovers.
