Unfortunately that would fall under this clause as in essence you are charging for access to the addon for download. In the broad scope blizzard is saying if you create an addon for wow it must be accessable to anyone who wants it with no money involved. Which means even for someone like me, who writes some stuff for their own personal use, i must supply a publicy accessable source for getting it free of charge. You could go so far as to require someone to come to your home to get a copy of it free of charge but it must be possible and if they did show up youd have to provide it. Anyone feel like jumping on a plane and flying over to my place to pick up a copy of one of my un-named addons? hehehe. Of course it is a lot easier just to have it uploaded to the web, and I have, but good luck finding it . I am NOT required to provide you with that source. It does exist but i doubt you will ever find it.

I can see the possibility of a certain disclaimer that was often used in the past in regards to other code out there stating someting along the lines of the code being provided for intelectual and educational uses only in regards to how to create an addon or write lua code and that the author declines any responability with what you do with it. Anyone else remeber those days? Of course you would not be able to advertise or associate it in anyway with blizzard or wow but they arnt the only ones using lua. Code is just Code.

Now as to the morality in what blizzard is doing, they are just doing what any major company would do. Do I think its right? No. As long as the addon does not violate the game in a way that gives a player an unfair advantage over other players such as in the case of cheats, hacks, automation or botting, then wether that person paid for it or not isnt relevent.
Personaly i do not feel you should have to pay for an addon, ever. So i choose not to use addons that require a subscription etc.
I take nUI as an exception because Scott is simply asking for donations if you feel like helping to continue devolpment of nUI. You will find something similar on many of my websites (i have over 5 personaly and many more privately or hosted). i donated for nUI before the whole Pro thing even came about because i felt Scott deserved it, and will again whenever i am capable of doing so. Wether scott has a pro version or not is moot and i will donate or not donate as i see fit irregardless of what i have access too.
